1. Terms
By accessing our website at SimpleMOT, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site (SimpleMOT.co.uk). The materials contained in this website are protected by applicable copyright and trademark law.
2. Use Licence
- Permission is granted to temporarily download one copy of the materials (information or software) on SimpleMOT’s website for personal, non-commercial transitory viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on SimpleMOT’s website;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or “mirror” the materials on any other server.
- This licence shall automatically terminate if you violate any of these restrictions and may be terminated by SimpleMOT at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.
3. Disclaimer
- The materials on SimpleMOT’s website are provided on an ‘as is’ basis. SimpleMOT makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
- Further, SimpleMOT does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
4. Limitations
In no event shall SimpleMOT or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on SimpleMOT’s website, even if SimpleMOT or a SimpleMOT authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
5. Accuracy of Materials
The materials appearing on SimpleMOT’s website could include technical, typographical, or photographic errors. SimpleMOT does not warrant that any of the materials on its website are accurate, complete or current. SimpleMOT may make changes to the materials contained on its website at any time without notice. However, SimpleMOT does not make any commitment to update the materials.
6. Links
SimpleMOT has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by SimpleMOT of the site. Use of any such linked website is at the user’s own risk.
7. Modifications
SimpleMOT may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the current version of these terms of service.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Northern Ireland and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
9. MOT Appointments
- It is your responsibility to attend any booked MOT appointments. We are not liable if you have selected an MOT date range and cannot make the appointment.
- You are not eligible for a refund of fees you paid to SimpleMOT if an MOT cancellation has been found and booked already by SimpleMOT, even if you sell your car or cancel the MOT booking for any reason. You may only be eligible for a refund of the original MOT booking fee from DVA in some cases. SimpleMOT is not affiliated with the Driver & Vehicle Agency (DVA) – Northern Ireland or NIdirect. - If you want to change your new MOT appointment after we found a cancellation for you, then please send us an MOT management request from one of your original MOT booking contacts (email/phone) with your current MOT reference number and registration or trailer ID number, and we will change the notification contact email/phone number back to the original one you made the original MOT booking with, so you will be able to manage your MOT booking directly again.
- If you want to get your new MOT appointment changed again for any reason and want us to get another MOT cancellation, please fill in our form on our website again and we will try to get back to you in 24–48 hours with available options.
10. Consent to Immediate Performance
SimpleMOT’s service is purchased online and is therefore a distance contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Under these Regulations, you normally have a 14-day cooling-off period during which you may cancel for any reason.
However, because MOT cancellation searches are time-sensitive and you require SimpleMOT to begin work promptly, by submitting your booking request and payment you expressly request that SimpleMOT begins providing the service immediately. You acknowledge and agree that:
- you are requesting that SimpleMOT commence work before the end of the 14-day cooling-off period;
- if SimpleMOT fully performs the service (i.e. finds and books a cancellation for you) before the cooling-off period expires, you will lose your right to cancel;
- if you cancel before the service is fully performed, you will be liable to pay for any work already carried out by SimpleMOT, calculated proportionately to the full service fee.
11. Authentication and Account Access
11.1 Overview
To search for and secure an MOT cancellation on your behalf, SimpleMOT requires access to your MOT booking. This access is obtained through an authentication process that is initiated by SimpleMOT within 48 hours of your form submission and requires your timely cooperation.
11.2 Authentication Code Forwarding
As part of this process, you will receive an authentication code (via SMS or other means) which you must promptly forward to SimpleMOT. Authentication codes are time-sensitive and typically expire within 20 minutes of being issued. You must forward the code to SimpleMOT within 15 minutes of receiving it to allow our system sufficient time to process it before expiry. Under normal circumstances, the entire authentication forwarding process takes approximately 2–3 minutes when completed promptly.
11.3 Failed or Delayed Authentication
If you fail to forward the authentication code within the required timeframe, or fail to respond to authentication requests altogether, SimpleMOT may be unable to access your MOT booking and therefore unable to search for or secure a cancellation appointment on your behalf.
SimpleMOT will make reasonable attempts to complete the authentication process (typically up to 3 attempts). If, after these attempts, authentication cannot be completed due to your failure to respond or to respond in time, SimpleMOT reserves the right to cease further attempts and treat the service as concluded.
11.4 Fees for Failed Authentication
You acknowledge that SimpleMOT incurs costs in initiating and processing each authentication attempt, including staff time, system resources, and messaging costs. If SimpleMOT is unable to complete the authentication process due to your failure to forward the authentication code within the required timeframe, or your failure to respond to authentication requests after repeated attempts, SimpleMOT is entitled to retain fees proportionate to the work already carried out and costs incurred. The amount retained will reflect SimpleMOT’s genuine costs and will not exceed the total fee you paid.
This applies regardless of the reason for your non-response, including but not limited to: forgetting to check your phone, being unavailable, changing your mind about the service, or choosing not to cooperate with the authentication process.
11.5 Misuse and Abuse
SimpleMOT reserves the right to refuse service and retain all fees paid where it reasonably suspects that a booking request has been submitted:
- fraudulently or using false information;
- for the purpose of testing, probing, or disrupting SimpleMOT’s systems;
- to use SimpleMOT’s messaging systems to generate unsolicited or nuisance messages to third parties; or
- without genuine intent to use the service.
12. Cancellation of Your Request
12.1 How to Cancel
If you wish to cancel your SimpleMOT request before the service has been completed, you must contact SimpleMOT by email or through the contact method provided on our website. Your cancellation request is not effective until it has been acknowledged by SimpleMOT, either through our automated system or manually by a member of our team.
12.2 When Cancellation Is Effective
A cancellation request is effective only at the point it is acknowledged by SimpleMOT. SimpleMOT will endeavour to acknowledge cancellation requests within 2 hours during business hours. If a cancellation appointment has been found and booked by SimpleMOT’s system before your cancellation request is acknowledged, the service is considered fully performed and no refund is available, regardless of when you sent your cancellation request.
For the avoidance of doubt: SimpleMOT’s system operates continuously and may find and book a cancellation at any time, including in the period between you sending a cancellation request and SimpleMOT acknowledging it. The determining factor is whether the cancellation was booked before or after SimpleMOT acknowledged your request, not when you sent it.
12.3 Deadline for Cancellation
You may only cancel your request and be eligible for a refund if all of the following conditions are met:
- you contact SimpleMOT to cancel before your desired MOT appointment date;
- SimpleMOT has not already found and booked a cancellation appointment for you at the time your cancellation is acknowledged; and
- you have either completed the authentication process successfully or have not yet been asked to authenticate (i.e. SimpleMOT has not yet incurred costs from failed authentication attempts on your behalf).
If your desired MOT appointment date has passed and you have not contacted SimpleMOT to cancel before that date, SimpleMOT considers the service concluded and no refund is available.
13. Refund Policy Summary
To summarise the refund position across these terms:
- Cancellation found and booked: No refund is available. The service has been fully performed (see Section 9 and Section 12.2).
- Customer cancels before desired date, before a cancellation is found, and no failed authentication attempts: Full refund available, subject to any proportionate deduction for work already carried out (see Section 10 and Section 12.3).
- Customer cancels before desired date, before a cancellation is found, but authentication attempts have failed due to customer non-cooperation: SimpleMOT is entitled to retain fees proportionate to the costs incurred from authentication attempts (see Section 11.4). Any remaining balance may be refunded.
- Desired date has passed without cancellation request from customer: No refund is available. The service is considered concluded (see Section 12.3).
- Authentication repeatedly failed due to customer non-cooperation and service concluded: SimpleMOT is entitled to retain fees proportionate to the work carried out and costs incurred (see Section 11.4).
- Misuse or abuse suspected: No refund is available. SimpleMOT retains all fees paid (see Section 11.5).
All refunds, where applicable, will be processed within 14 days of SimpleMOT acknowledging the cancellation request and will be made using the same payment method used for the original transaction unless otherwise agreed.
14. Your Statutory Rights
Nothing in these terms is intended to exclude or limit any rights you have under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable consumer protection legislation. Where any provision of these terms conflicts with your statutory rights, your statutory rights shall prevail.
